Subject: PGM - Action Needed on Expiring Conservation Program Contracts
Date: July 21, 2009
Purpose. To transmit guidance to modify, cancel or terminate
expiring program contracts.
Expiration Date. September 30, 2009.
Explanation.
A Conservation Program Contract (CPC) that has expired may not be modified
after the date of expiration. Attachment A has a listing sorted by expiration
date and by county of CPCs’ expiring in August, September and December of this
year. Modifications to extend these contracts must be completed as per 440 Part
512, Subpart F prior to the expiration date of these contracts. Practices within
a contract may only be re-scheduled once within the lifetime of that contract.
The District Conservationist will review the attached list and refer to Part
512 Subpart F (Draft CPC Manual) for required actions. These actions include:
- Send a certified return receipt letter notifying the producer the
contract will expire;
- Practices that have been re-scheduled once cannot be re-scheduled again.
A modification can be completed to extend the expiration date no more than
six (6) months from the original expiration date. Longer time extensions
must be approved in advance by the appropriate Program Manager;
- All delayed practices must be completed prior to the new expiration
date;
- All modifications require the participant’s signature;
- Complete all modifications at least 10 business days prior to the
expiration date.
