Subject: LTP - FY08 Conservation Security Program (CSP) Notification of Land Loss
Date: November 14, 2007

Purpose. To provide guidance to Field Offices for working with producers who have lost control of land enrolled in CSP.

Expiration Date. September 30, 2008.

Explanation.  During the 2008 CSP payment process some participants have notified Field Offices that they have lost control of all or part of the land in their CSP contract.

Loss of land may be a potential contract violation. The State Conservationist will determine if the violation warrants termination of the CSP contract, cost recovery and assessment of liquidated damages. Refer to: CSP Manual 518.100 & 103; Public Law 107-171; National Bulletin 300-7-19; and Regulation 7 CFR Part 1469 for more information.

A "findings of facts" must be prepared and presented to the CSP Manager describing the conditions under which the participant lost control of the land and whether this loss of control was voluntary or involuntary.

Before a CSP Contract can be modified, the following steps must be completed:

  1. Obtain "Notification of Loss of Land" in writing from Participant.
    (Use the attached Notification of Loss of Land Form or have Participant submit a letter that covers the questions on the form.)
  2. Complete Contract Review (CPA 13) as per CPM 512.71
  3. Forward the "Notification of Loss of Land" and CPA 13 to the CSP Manager, Tiffany Laws.
  4. The Designated Conservationist will be notified in writing of the State Conservationist's decision to proceed with the contract modification or termination.
